Every year people wonder: <strong>Is rent tax-deductible when it concerns my income tax return?<\/strong> The answer is yes, but you must take into account several requirements before doing so.<\/p>\n<p style=\"text-align: justify;\">For tenants the <strong>tax-deductible part of income tax return <\/strong>is divided in two elements: one on a country level (except for Navarra and Basque country) and one on a regional level. As we already mentioned, there are two parts that are deductible in your income tax return. These are the following:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>State deduction<\/strong>: you can include this in your tax declaration if you have been living in the same rental apartment since before the year of 2017, also if you have renewed your contract or prolonged it. You are allowed to deduct <strong>10.05% of your rent on a maximum amount of \u20ac9,040 per year<\/strong>, so there is a maximum of \u20ac904 that can be deducted from the rent of the property on your income tax return.<\/li>\n<li><strong>Regional deduction<\/strong>: every autonomous region decides on its own conditions. If you are living in a <a href=\"https:\/\/www.shbarcelona.com\/\"><strong>rental apartment in Barcelona<\/strong><\/a> you need to know that it is possible to deduct <strong>10% of your rent with a maximum of \u20ac300 per year<\/strong>, or, if it concerns a family, \u20ac600 per year.<\/p>\n<p style=\"text-align: justify;\">To proceed with this deduction, you need to check if you meet the <strong>requirements<\/strong>:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>One of the following situations<\/strong> applies to you:\n<ul>\n<li>You are 32 years of age or younger<\/li>\n<li>You are a widow\/widower age 65 or older<\/li>\n<li>You have been unemployed for more than 183 days (during the tax year it concerns)<\/li>\n<li>You have a degree of disability of at least 65%<\/li>\n<\/ul>\n<\/li>\n<li>The <strong>total taxable amount<\/strong> may not exceed \u20ac20,000 (or \u20ac30,000 if it concerns large families)<\/li>\n<li>The amount paid for rent is <strong>more than 10%<\/strong> of your net income&nbsp;<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">If you match these requirements, you are allowed to declare the rent in your income tax return this year, but remember you can only do this once.<\/p>\n<p style=\"text-align: center;\"><a class=\"fasc-button fasc-size-large fasc-type-flat fasc-rounded-medium ico-fa fasc-ico-before fa-chevron-circle-right broken_link\" style=\"background-color: #850909; color: #ffffff;\" href=\"https:\/\/www.shbarcelona.com\/yearly-rental\" rel=\"nofollow\">Moving to Barcelona? However, from the income you received for the rental apartment, you as an owner can deduct several aspects that we will explain to you below.<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Expenses_that_are_tax-deductible_with_rent\"><\/span>Expenses that are tax-deductible with rent<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"1_Mortgage_interests\"><\/span>1. Mortgage interests<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">If you have taken out a mortgage, you may deduct the <strong>interest and commissions<\/strong> paid <strong>for early amortization of this mortgage<\/strong>. However, do not confuse this fact with the monthly amount of mortgage you are paying the bank.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0104<\/strong> of your income tax return<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"2_Community_fees\"><\/span>2. Community fees<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">You may deduct the property&#8217;s community fees. In your tax return you will recognise this as <em>&#8220;cantidades devengadas por terceros como consecuencia de servicios personales&#8221;<\/em>.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0109<\/strong> of the income tax return<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"3_Maintenance_and_repair_costs\"><\/span>3. Maintenance and repair costs<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">The most important aspect of these costs is that it must be clear to you what Tax Authorities consider to be maintenance and repair costs, since obviously <strong>not all of them will be included<\/strong>. The Tax Agency will agree deducting these costs, as long as you replace a property element for a similar one, and not for a better one.<\/p>\n<p style=\"text-align: justify;\">So you may include the costs of painting, fixing installations (like the heating or boiler, doors, elevators, etc.) as long as you do not replace it with a better, more modern, or updated version of the element.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0107<\/strong> of your income tax return<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"4_Property_related_taxes\"><\/span>4. Property related taxes<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">The taxes you pay on the property can be deducted, since they are part of the taxes that you must pay when renting out the property. These taxes are: the Real Estate Tax (IBI), garbage collection, public road lighting and parking space entrances.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0115<\/strong> of the income tax return<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"5_Rental_property_depreciation\"><\/span>5. Rental property depreciation<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">To be clear, you are allowed to deduct 3% of the cadastral value of the apartment. To calculate the tax-deductible part, just find the value and apply the percentage. You will then subtract this amount from your income and know what the depreciation of the property is.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0118<\/strong> of the income tax return<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"6_Depreciation_of_goods\"><\/span>6. Depreciation of goods<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">If you have invested in movable goods (for example household appliances, furniture, installations, etc.), they can also be deducted.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0117<\/strong> of your income tax return<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"7_Home_insurance_premium\"><\/span>7. Home insurance premium<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">You may deduct <strong>several types of insurances<\/strong>: multi-risk, fire, civil liability, glass breakage, non-payment of rent, etc.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; You will find this item in the section <em><b>\u201cOtros gastos fiscalmente deducibles\u201d<\/b><\/em>.<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"8_Utility_costs\"><\/span>8. Utility costs<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">If you as the property owner are responsible for paying <a href=\"https:\/\/www.shbarcelona.com\/blog\/en\/utility-charges-and-internet\/\"><strong>utility<\/strong><\/a> costs (like water, electricity, gas, internet&#8230;) you may deduct these in your income tax return.<\/p>\n<p style=\"text-align: justify;\">&#x1f4dd; Mark this in <strong>box 0113<\/strong> of <em>la Renta<\/em><\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"9_Unpaid_rent\"><\/span>9. Unpaid rent<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">Sometimes you will have a tenant that, unfortunately, will <a href=\"https:\/\/www.shbarcelona.com\/blog\/en\/rent-protection-insurance\/\"><strong>not pay their monthly rent<\/strong><\/a>. If this is the case with you, you are allowed to deduct these <em><strong>\u201csaldos de dudoso cobro\u201d<\/strong><\/em>.
