Without one, each and every resident could live by his own set of rules and make changes to the property without consulting other residents. As a result, <strong>the people who are in charge of setting up the homeowners&#8217; association are going to be the homeowners themselves<\/strong>.<\/p>\n<p style=\"text-align: justify;\">We will now tell you about the process and steps:<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"1_Hold_the_first_HOA_meeting\"><\/span>1. Hold the first HOA meeting<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Every homeowner must be present during this <strong>first meeting<\/strong> (called <strong><em>Junta Constituyente<\/em><\/strong> in Spanish). Drawing up the Articles of Incorporation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The <strong>Articles of Incorporation<\/strong> <em>(Acta de Constituci\u00f3n)<\/em>&nbsp;are drawn up during the very first meeting, and they contain all the information and agreements that the attendees at the meeting agreed upon. The names of everyone who was there will be written down, but also, for example, who voted in favour of the association and who didn&#8217;t.<\/p>\n<p style=\"text-align: justify;\">It must be <strong>signed by the president and the secretary of the homeowners&#8217; association<\/strong>, and then it needs to be submitted to the Spanish <em>Registro de la Propiedad<\/em>.&nbsp;<\/p>\n<p style=\"text-align: center;\"><a class=\"fasc-button fasc-size-large fasc-type-flat fasc-rounded-medium ico-fa fasc-ico-before fa-chevron-circle-right broken_link\" style=\"background-color: #850909; color: #ffffff;\" href=\"https:\/\/www.shbarcelona.com\/owners-services\" rel=\"nofollow\">Property owner? Legalising Minute Book<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">In order to <strong>legalise the minute book<\/strong> <em>(Libro de Actas)<\/em>, first it must be presented totally blank to the <strong><em>Registro de la Propiedad<\/em> where the property is registered<\/strong>. The minute book comes with a signed request from the president of the HOA, and the whole process will take about a week.<\/p>\n<p style=\"text-align: justify;\">Once the minute book is approved, <strong>all the agreements of the homeowners&#8217; association meetings<\/strong> will be written down in this book, and more specifically they will contain the Articles of Incorporation.<\/p>\n<p style=\"text-align: justify;\">This type of <strong>book<\/strong> can be bought at any book shop, and it will cost around 20 euros.<\/p>\n<div id=\"attachment_71300\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-71300\" class=\"wp-image-71300 size-shareaholic-thumbnail\" src=\"https:\/\/www.shbarcelona.nl\/blog\/nl\/wp-content\/uploads\/2021\/07\/pexels-matthias-zomer-618158-640x360.jpg\" alt=\"sign a contract\" width=\"640\" height=\"360\"><p id=\"caption-attachment-71300\" class=\"wp-caption-text\"><em>Photo via Pexels<\/em><\/p><\/div>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"4_Getting_a_NIF\"><\/span>4. Getting a NIF<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The president should then visit the corresponding Tax Office <em>(Delegaci\u00f3n de Hacienda)<\/em> and <strong>apply for the NIF for the homeowners&#8217; association<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Once you are at the office, you will have to fill in and sign form <strong>037 of the Agencia Tributaria<\/strong>, and you will also need to provide the following documentation:&nbsp;<\/p>\n<ul>\n<li style=\"text-align: justify;\">Copy of the president&#8217;s DNI<\/li>\n<li style=\"text-align: justify;\"><em>Escritura de Divisi\u00f3n Horizontal<\/em> of the property<\/li>\n<li style=\"text-align: justify;\">Copy of appointing the president of the HOA<\/li>\n<\/ul>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #ffe6c9;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">\n<p style=\"text-align: justify;\"><b>&#x1f4cc; The <em>Escritura de Divisi\u00f3n Horizontal<\/em> of the property is a document that states all the necessary information on the HOA. For example: its communal spaces, a description of the apartments in the building, and the owners&#8217; fees.<\/b><\/p>\n<p style=\"text-align: justify;\"><strong>It is important that all the homeowners from the building receive their copy of this document when the association is set up, so they know what is specified in the
