In these rules the Board of the homeowners association must define the <strong>timetable<\/strong> for the use of, and the <strong>activities<\/strong> that are allowed on the terrace.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"A_communal_terrace_for_private_use\"><\/span>A communal terrace for private use<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Sometimes all the floors with <strong>apartments<\/strong> have <strong>access to the same terrace<\/strong>. Other times, for example in the case of <strong>two rooftop apartments<\/strong> sharing the same staircase to the roof, the residents of these two apartments have the key to a roof terrace.&nbsp;<\/p>\n<p style=\"text-align: justify;\">If your apartment enjoys a private terrace, then you are in luck. There is the <em>Ley de Propiedad Horizontal<\/em> on the one hand, and article 394 of the Civil Code on the other.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"What_does_the_Ley_de_Propiedad_Horizontal_say\"><\/span>What does the Ley de Propiedad Horizontal say?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Article 7.1:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>The owner of each apartment or property is allowed to modify its building elements, installations or services, as long as it doesn&#8217;t affect the safety, general structure, external appearance or state of the building, and as long as it doesn&#8217;t violate the rights of other owners. The homeowners association must always be given prior notice.&nbsp;<\/em><\/p>\n<\/blockquote>\n<h3><span class=\"ez-toc-section\" id=\"And_what_does_the_Civil_Code_say\"><\/span>And what does the Civil Code say?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Article 394:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>Every resident can make use of communal spaces, as long as they are used the way they were intended to be used and the community is not harmed in any way.
