(LAU)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Aquesta <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1994-26003\" target=\"_blank\" rel=\"nofollow\"><strong>llei regula tot el relatiu a lloguers<\/strong><\/a> des de 1964, i s&#8217;ha anat actualitzant per a protegir m\u00e9s l&#8217;inquil\u00ed i als propietaris. Les reformes m\u00e9s importants s\u00f3n les de <strong>1995, 2013 i 2019<\/strong>, i les reformes m\u00e9s recents s&#8217;han aprovat aquest mateix any 2021.<\/p>\n<p style=\"text-align: justify;\"><strong>Per a comen\u00e7ar, la llei aplica a tota finca urbana<\/strong> que es llogui a manera d&#8217;habitatge, o per un \u00fas diferent, en un immoble que sigui habitable, places d&#8217;aparcament, trasters o qualsevol accessori de la finca.<\/p>\n<p style=\"text-align: center;\"><a class=\"fasc-button fasc-size-large fasc-type-flat fasc-rounded-medium ico-fa fasc-ico-before fa-chevron-circle-right\" style=\"background-color: #a50022; color: #ffffff;\" href=\"https:\/\/www.shbarcelona.cat\/lloguer-llarga-estada\" target=\"_blank\">Troba el millor pis de lloguer a Barcelona<\/a><\/p>\n<p style=\"text-align: justify;\">Ha d&#8217;existir un <strong>contracte pel mig<\/strong> on s&#8217;estipuli la cessi\u00f3 d&#8217;un immoble a canvi d&#8217;un import econ\u00f2mic (renda). Els propietaris, al seu torn, tamb\u00e9 <strong>han de con\u00e8ixer quines modificacions s&#8217;han produ\u00eft <\/strong>sobre aquest tema per a saber a qu\u00e8 atenir-se.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Termini_de_prorroga_obligatoria\"><\/span>Termini de pr\u00f2rroga obligat\u00f2ria<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">El primer canvi destacable \u00e9s que la durada del contracte de lloguer, passa de ser de 3 anys a 5 anys. Al mateix temps, s&#8217;estableix un <strong>termini de pr\u00f2rroga obligat\u00f2ria<\/strong> de 3 anys sempre que cap de les dues parts manifesti voluntat expressa de rescindir el contracte.<\/p>\n<p style=\"text-align: center;\"><a class=\"fasc-button fasc-size-large fasc-type-flat fasc-rounded-medium ico-fa fasc-ico-before fa-chevron-circle-right\" style=\"background-color: #a50022; color: #ffffff;\" href=\"https:\/\/www.shbarcelona.cat\/\" target=\"_blank\">Cerca aqu\u00ed el teu pis ideal a Barcelona<\/a><\/p>\n<p style=\"text-align: justify;\">Quan l&#8217;arrendador \u00e9s una persona jur\u00eddica, el termini de pr\u00f2rroga obligat\u00f2ria tamb\u00e9 \u00e9s de 3 anys, per\u00f2 la durada del contracte \u00e9s de <strong>7 anys sempre<\/strong>. L&#8217;inquil\u00ed ha de tenir present que haur\u00e0 de notificar amb <strong>2 mesos d&#8217;antelaci\u00f3<\/strong> la rescissi\u00f3 del contracte.<\/p>\n<blockquote><p>Si el propietari al\u00b7lega la necessitat de l&#8217;habitatge, segons la Llei d&#8217;Arrendaments Urbans el contracte no es prorrogar\u00e0 autom\u00e0ticament. Sempre que consti de manera clara en el contracte.<\/p><\/blockquote>\n<p style=\"text-align: justify;\">La llei d&#8217;arrendament urb\u00e0 no obliga a una durada de contracte especifica, el que regula \u00e9s simplement <strong>com es prorrogar\u00e0 de manera autom\u00e0tica<\/strong>, sempre que totes dues parts no expressin el contrari.<\/p>\n<p style=\"text-align: center;\"><em>Article relacionat: <\/em><a href=\"https:\/\/www.shbarcelona.cat\/blog\/cat\/llogar-o-comprar-a-barcelona\/\" target=\"_blank\"><em>Llogar o comprar a Barcelona?<\/em><\/a><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Despesa_de_les_gestions\"><\/span>Despesa de les gestions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Una altra dada important \u00e9s que en el cas en qu\u00e8 <strong>l&#8217;arrendador sigui una persona jur\u00eddica<\/strong>, les despeses de <strong>gesti\u00f3 immobili\u00e0ria aniran a c\u00e0rrec de l&#8217;arrendador<\/strong>, excepte en el cas dels serveis que hagin estat contractats a iniciativa directa de l&#8217;arrendatari.<\/p>\n<p style=\"text-align: justify;\">Pel seu costat, en els c<strong>ontractes de fins a 5 anys de durada o fins a 7 anys en cas de persones jur\u00eddiques<\/strong>, el <strong>valor de la garantia addicional (fian\u00e7a o aval)<\/strong> no podr\u00e0 excedir de 2 mensualitats de la renda.<\/p>\n<p style=\"text-align: justify;\">Al seu torn, es torna al <strong>principi de llibertat de pacte<\/strong> en arrendaments d&#8217;habitatge de superf\u00edcie superior a 300 m\u00b2 o de renda inicial superior a 5,4 vegades el salari m\u00ednim interprofessional.<\/p>\n<div id=\"attachment_13130\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img aria-describedby=\"caption-attachment-13130\" class=\"size-full wp-image-13130\" src=\"https:\/\/www.shbarcelona.cat\/blog\/cat\/wp-content\/uploads\/2019\/02\/ley-3.jpg\" alt=\"llei lloguers\" width=\"640\" height=\"427\" srcset=\"https:\/\/www.shbarcelona.com\/blog\/cat\/wp-content\/uploads\/2019\/02\/ley-3.jpg 640w, https:\/\/www.shbarcelona.com\/blog\/cat\/wp-content\/uploads\/2019\/02\/ley-3-300x200.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-13130\" class=\"wp-caption-text\">Foto via Unsplash<\/p><\/div>\n<h3><span class=\"ez-toc-section\" id=\"Limits_en_el_preu_de_la_renda\"><\/span>L\u00edmits en el preu de la renda<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">A m\u00e9s, s&#8217;introdueix un <strong>l\u00edmit en l&#8217;actualitzaci\u00f3 de l&#8217;IPC<\/strong> en contractes de renda redu\u00efda, concepte nou definit en <strong>l&#8217;article 18 de la Llei d&#8217;Arrendaments Urbans<\/strong> (LAU). Tamb\u00e9 s&#8217;estableix <strong>exempci\u00f3 del pagament del ITP en els lloguers d&#8217;habitatge permanent<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Despr\u00e9s dels 5 anys de durada del contracte, 7 anys en cas de les persones jur\u00eddiques, es podr\u00e0 augmentar la renda anual, sempre que aquest augment no superi el 20% de la renda vigent en aquest moment.<\/p>\n<p style=\"text-align: justify;\">A m\u00e9s d&#8217;efectuar <strong>obres de millora per part de l&#8217;arrendador<\/strong>, encara que si es pacta entre inquil\u00ed i propietari, aquestes obres es podrien realitzar sense la necessitat de signar un nou contracte.<\/p>\n<p style=\"text-align: justify;\">Actualment tamb\u00e9 es regula la <a href=\"https:\/\/www.shbarcelona.cat\/blog\/cat\/fianca-lloguer-pis\/\" target=\"_blank\"><strong>fian\u00e7a<\/strong><\/a>, cosa que no existia anteriorment, a <strong>un m\u00e0xim de 3 mesos de dip\u00f2sit<\/strong>. La fian\u00e7a real equival a la quantitat d&#8217;un mes de renda, els altres dos corresponen a una garantia addicional.<\/p>\n<p style=\"text-align: justify;\">Si els lloguers no tenen la fi de residir en l&#8217;immoble, com en el cas dels locals, la fian\u00e7a legal \u00e9s de dos mesos, tal com es regula en l&#8217;article 36.2 en les \u00faltimes reformes de la <strong>Llei d&#8217;Arrendaments Urbans.<\/strong><\/p>\n<p style=\"text-align: center;\"><a class=\"fasc-button fasc-size-large fasc-type-flat fasc-rounded-medium ico-fa fasc-ico-before fa-chevron-circle-right\" style=\"background-color: #a50022; color: #ffffff;\" href=\"https:\/\/www.shbarcelona.cat\/barcelona-lloguer\/eixample\" target=\"_blank\">Vols allotjar-te a Barcelona? Troba aqu\u00ed el teu pis de lloguer<\/a><\/p>\n<p style=\"text-align: justify;\">No hi ha regulaci\u00f3 en els mesos que corresponen a la garantia de la fian\u00e7a quan els contractes s\u00f3n de llarga estada. Aquests contractes signen <strong>per\u00edodes inicials de m\u00e9s de cinc o set anys<\/strong>.
